Didn't receive item.. seller wants to deduct shipping from refund.

Purchased an item about a week ago, seller was less than 20 miles away. Shipping was free and I never received the item. Contacted the seller who admonished me for not purchasing insurance, blamed the USPS, but promised to send my item. Now seller is "out" of the item and won't have it back in stock for another week. I'm leaving town and needed the item/ If I want to get a refund, the seller wants to deduct shipping costs, paypal costs and ebay seller costs. I think this is totally unreasonable.. File INR and get a FULL refund, Item price plus what you paid for shipping/handling That being said Even at only 20 miles a week is too soon to worry about a "lost" package. As nowibuy..., said file an Item Not Received INR dispute immediately bump it to a claim. Never buy anything on Ebay that you need quickly, you never know what will happen. " If you only purchased the item "a week ago, you have under normal circumstances NOT allowed enough time to pass for the item to be received. Depending on how/what method of shipping was stated in the auction a general rule is at least (minimum) 10 business days for an item to arrive (domestic) and 30 days for International. As for the "insurance" , your seller is 100% wrong. Sellers may NOT offer or charge for insurance as per the Selling Practices policy here Link Seller must include/incorporate any insurance in the s&h or item price. They can not charge extra and can NOT deny liability for a non delivery due to the post office/shipping carrier. If the seller is out of stock , this too is a violation of the same above policy! It is not the seller's issue you are going out of town and need the item asap. NEVER buy something on the internet that is time sensitive. Sellers are NOT allowed to deduct any of those costs from a refund. File the INR (item not received) now with Paypal. Seller will be given 7 days to provide proof of delivery or Paypal will refund you item price and S&H. This is your only choice. Your seller is out of line completly, but you also have some what unrealistic expectations for a 5 day receipt after purchase. Sellers have 7 days from receipt of a cleared payment to ship under Paypal/Ebay rules.|||Since the seller is out of stock, saying "you should have purchased ins and is stating they will deduct Ebay/Paypal fees from any refund, you need to report the seller for NON Performance here Link Then file the INR for non delivery with Paypal asap. I bought something from a seller less than 20 miles away shipping was via USPS Priority mail. We are talking CT to NY just across the state boarder. The package was shipped the day after cleared payment and the USPS took exactly 13 days to deliver. This was in no way the seller's fault or choice. It has more to do with the USPS route than the actual distance between seller and buyer. You can not and should not base every expected delivery time on previous experience, that is very unfair to your sellers. The USPS is/has changed routing for cost saving reasons, which sellers have NO control over.|||If the seller is out of stock , this too is a violation of the same above policy! The seller did not violate policy! The seller has shipped the item, and simply does not have a 2nd one to ship to the buyer. The seller does not have to keep unlimited stock to keep reshipping every time an item doesn't show up in a week! Sometimes you people are completely ridiculous!|||scmguru - you are way jumping the gun. You can file an INR claim, the seller can take 10 days to respond and then upload the Delivery confirmation information and you will lose the case. Just be patient and wait, and if it doesn't come by the time you return from your trip, THEN file a claim.|||"The seller did not violate policy! Sorry, but if the item was listed and is not available for shipping because the seller is out of stock, then it does violate the Selling Practices policy for availability.|||Agreed buying an item and expecting delivery within 5-7 days or less is jumping the gun.|||
