Ebay Buyer Protection NOT to be Trusted
I bought a website through Ebay. I called Ebay five different times and always was reassured that my purchase was protected under the Buyer Protection Policy befure I bought. I was further reassured that using escrow.com "eBay's approved escrow service," was included on the protection. I was misinformed each time, apparently, because after the I bought it and the seller reneged his 60 day money back guarantee, Ebay has left me holding the basket. They will not honor their Buyer Protection, even though during the case period, I received info from ebay that I was protected!! Ebay has really let me and everyone down with this. I am still pursuing legal options. Ebay buyers, beware!|||The eBay/Paypal protection period is 45 days, not 60 days. I cannot speak to escrow services. Susan|||OP some actual facts are usually helpful......|||Conditions under which a case can be filed under the eBay Buyer Protection Policy Buyers can file a case under the eBay Buyer Protection Policy when all of the following are true: You are an eligible buyer (see Buyer eligibility). You completed a purchase of an eligible item on eBay and submitted a claim within 45 days from the date of payment. You purchased the item on eBay by using the Pay Now option, third-party checkout, or an eBay invoice. You paid for the item in one lump payment (transactions involving multiple payments, such as a deposit followed by a final payment, are not covered). You used one of the following methods listed below: PayPal ProPay Moneybookers Paymate Credit card or debit card processed through the seller's Internet merchant account Bill Me Later eBay Buyer Protection is not available if you have paid using payment methods not specified in this policy. The item is not excluded from the eBay Buyer Protection Policy (see Exclusions). It may not be your fault but it is your responsibility Silver rule "do not do to others what you would not like to be done to you"|||You should read the details of the policy. There is a 45-day deadline for filing a claim. Intangible items are not covered. A website is not a physical item, it's an intangible item.friends Director,|||OP's "item" for sale is interesting...|||the Buyer Protection Policy Did you even read it?|||OP says that reps at EBAY said the purchase was covered. OP, if you used your CC, you can do a chargeback. If not, does Ebay allow you to sell the website and domain?Need a website fast?||||||ominbound1 From your listing " I am so sure that you will love this cure and that it will work if you follow my advice that I'm offering it on the honor system." Now , WHY would anybody bid or do a Buy It Now for $2 , when you have already given them the information? Your statement in the auction about " Feel Free to donate more than the $2" is not allowed and even more ridiculous. You are wasting your money with the listing in it's present form.|||Yes, the cure listing was mostly a joke. But if you have suffered from athlete's foot, and this cured you, you would gladly pay something for the real relief that this will bring. BUT, I called Ebay 5 times to inquire about how to buy the website and was I covered. I was told EVERY time that I was. I was told that escrow.com was approved and would indeed be included for the Buyer Protection. I DID read the conditions of the Buyer Protection, called for clarification, since the website certain raised issues if it was "intangible" and I assure you, I was told every time that is WOULD be included and escrow.com was approved. (It says escrow.com is the only approved escrow service on Ebay elsewhere on Ebay, that is why I called to confirm) I did all the homework I believed necessary, since Ebay has been good in the past, but their reps will pretty much say anything you want to hear, I believe, until money is on the line.|||Oh, and I started the process before the 45 days was up, having read the policy, even though the seller offered 60.|||omin, you should email the full story and your concerns to Jim Griffith (Griff), griff@ebay.com. He's one of the head customer service guys and should be able to help you out. At the very least, he'll be able to see to it that the reps at eBay are properly trained on this issue. Here is the part of the policy that excludes websites: Items listed or that should be listed (under our listing policy) in these categories: * Motors (except "Parts and Accessories") * Real Estate * Classified Ads Websites are digitally delivered, so they fall under this policy: Link. They must be listed as Classified Ads (properly), and so are excluded from coverage. The verbiage in the Buyer Protection policy is IMO too vague in this area, which may be causing the confusion by the reps.friends Director,|||Now THAT, Plush, is good advice. I thank you and will do this.|||I don't think they protect buyer at all. 1. The seller me all the wrong details that hey could give to make you to buy the product. I ended up buying the production believing what seller said was true. 2. After got the product I found the information was wrong. I contacted the seller. 3. Wrote several messages to the seller for which he did not protect you. Again Ebay says they can not do anything. 4. Filed a case in Ebay Buyer protection option. The person who logged the complaint wrote my description as "Warranty Issue" even though I said I was worried about the product quality. 5. The let you and the seller to fight first. After few days the said a. They are not responsible for the sellers lie. Basically means he can write what ever he wants to sell his product. b. The are not concerned about the messages you and seller had. c. They are concerned only about physical Item. The person who will speak to you will not even have a slight clue of what type of electronic item she is dealing with and what is the significance that your claim has related to the product quality. d. They consider things like mechanical. It works or not that is all they wanted. e. So finally they used the information they logged "warranty" as an escape route to get out from the protection claim. 6. One funny things, she said she closed the case while talking to me. I was surprised to know that they act as if they are listening to you and will allow you to shout as much as you want. But its all decided way before they start to talk to you. They just try to log as they chat with you and closed the case. 7. They things is that I was planning to take the lens I bought to be tested in the shop and was just waiting for the verdict to happen and then take it out as I does not need to pay a fee for testing. Now even if I say the product is not working, I don't know how I am going to convince these people. 8. They are trained with tricks to just close a transaction. The seller is clever as this is his full time job. The buyer, just because he is new, he is one who gets cheated.
