Ebay's buyer protection is a Joke

So recently I bought an Ipod Touch 2nd Gen from seller strainjah32 and before I bought the item I asked him the condition of the ipod screen and he said mint condition,zero scratches. But when I received the Ipod it was heavily scratched and the pic didn't match the item I received. So opened a dispute claim through the ebay buyer protection and explained what happened but they favored the seller strainjah32. Now how is this fair, I get screwed into buying something I wasn't expecting where the seller put a fake pic and lied about the items condition???????????? This is the last time I buy anything from Ebay|||What was the reason they sided with the seller?|||What did you say in the dispute to explain the differences in the ad and what you received?It may not be your fault but it is your responsibility Silver rule "do not do to others what you would not like to be done to you"|||But when I received the Ipod it was heavily scratched and the pic didn't match the item I received. Like the generic picture of the one you are selling not showing damage? The back of the Ipod has scratches from normal use and the front screen has a few minor scratches but won't interfere while the ipod is in use. From your auction. You stated you lost the dispute and that usually only happens for a few specific reasons. Perhaps it was simply closed automatically due to opening two cases and the seller did not win as you stated. Stick with paypal and describe exactly what was SNAD and you should be refunded unless there is more to the story.|||eBay likely closed your case in favor of the seller because you filed with PayPal at the same time. Filing with both is a big no no.|||EBay buyer protection is a big joke ! I bought pens from a seller of Malaysia. On the listing the silver pen was with a silver box. I received blue carton boxes instead of silver boxes. Ebay close the case in favor of the seller. According to eBay : " it states that the items are presented in the box but not that they came with them." The listing : "... are presented in the matching color paper box. " And the seller admited that the silver boxes are no longer availables... and remove the silver box picture from his listing. I think , because EBay want to make $$$$$$$$$ in Asia , they will protect big sellers from Asia instead of buyers from North America !|||You filed a claim because of the color of the box? How ridiculous. You do realize you would have to pay to return them and do so with a method of shipment that provided tracking in order to get a refund?
