Seller trying to cancel Buy It Now agreement

I purchased an item through Buy It Now whose price shot up $200 in the days following my purchase. The seller now wants to cancel the auction, claiming he's out of stock and that his supplier is too. It seems he's claiming he was selling items he didn't actually have; he wants to cancel, but I've talked him in to trying to get one of the items for me. (Selling an item you don't have isn't allowed, right?) I'm concerned, though, that he's going to fall through, and every day he delays, it's going to get harder for me to get the item elsewhere. Would it be ok with EBay for me to ask him to not only refund my money but pay me the difference in price I'm now going to be forced to pay? That is, I'd agree to cancel the Buy It Now only if I first received $200 plus a full refund. Would this work? What other options do I have? I'm mostly concerned with getting the item, hopefully avoiding a $200 markup from when I actually bought. Thanks.|||You've GOT to be kidding.|||I guess some people don't know what the word 'extortion' means.|||Another day, another nightmare buyer...|||Many people on eBay use drop-shippers. There isn't any rule that I know of against that. Don't be greedy, as long as you get your money back, you are whole. Don't try to extort more with threats. "Be kinder than necessary, for everyone you meet is fighting some kind of battle."|||You are only due a refund of the amount you paid.Ebay will not force a seller to do more than that and can not force seller to ship. Sellers are allowed to sale items they do not have on hand-ex. drop ship and presale items.Of course there are consequences to not being able to fulfill and order. You can reflect your upset in factual feedback and a non performing seller complaint. It may not be your fault but it is your responsibility Silver rule "do not do to others what you would not like to be done to you"|||Would this work? NO What is wrong with you?? dvgvintage|||Out of Your Mind|||How bizarre! _______________________ "So many negs! So little time!"|||Do you also try to pull this at your local Wallyworld, if they are out of stock? Seller owes you only the exact amount you paid (item price nd S&H paid), not a dime more.
